Welcome to nowakdental.com. These Terms & Conditions (the “Terms”) govern your access to and use of the website and your purchase of products from Nowak Dental Supplies, Inc. (“Nowak,” “we,” “us,” or “our”). By browsing this site, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

1. Who we are

Nowak Dental Supplies, Inc. is a family-owned supplier to dental laboratories and dental practices, in continuous operation since 1944.

2. Who may purchase

This site is intended for dental professionals, dental laboratories, and dental practices purchasing for business use. Many products are intended for use by trained dental professionals only. By ordering, you represent that you are at least 18 years old, are authorized to transact on behalf of your business, and will use the products in accordance with their intended professional purpose and all applicable laws and regulations.

3. Your account

You are responsible for keeping your account credentials confidential and for all activity under your account. Please notify us promptly at support@nowakdental.com if you believe your account has been used without authorization. Information you provide must be accurate and kept current.

4. Products, descriptions, and availability

We work to describe and picture products accurately, but we do not warrant that descriptions, images, specifications, or other content are complete, current, or error-free. Manufacturer specifications may change. Products are subject to availability, and we may limit quantities, discontinue items, or correct errors at any time. Where a product is special-ordered or not held in stock, estimated lead times are provided as guidance, not guarantees.

5. Pricing and payment

Prices are shown in U.S. dollars and may change without notice. Contract and account-specific pricing, where applicable, is governed by your agreement with us. We reserve the right to correct pricing or typographical errors even after an order is placed; if a price was listed incorrectly, we will contact you before processing. You authorize us to charge your selected payment method for the total order amount, including applicable taxes and shipping. Applicable sales tax is added unless a valid exemption certificate is on file.

6. Orders and acceptance

Your submission of an order is an offer to purchase. An order is accepted only when we confirm and ship it, or otherwise notify you of acceptance. We may decline or cancel an order for reasons including product unavailability, suspected error, or suspected fraud. In-stock orders generally ship the same business day.

7. Shipping, title, and risk of loss

Shipping timeframes are estimates and not guaranteed. Unless otherwise agreed in writing, title and risk of loss pass to you upon our delivery of the products to the carrier. Please inspect shipments promptly and report visible damage or shortages to the carrier and to us right away.

8. Returns and refunds

Returns are handled in accordance with our Returns & Refunds policy. Certain items—including custom, special-order, consumable, hazardous, or sterile products—may be non-returnable for safety and regulatory reasons. Please contact us to request a return authorization before shipping any product back. Refunds, when approved, are issued to the original payment method.

9. Regulatory and professional use

Many products sold on this site are dental or medical devices or materials intended for use by, or under the supervision of, licensed dental professionals. You are responsible for using products in accordance with the manufacturer’s instructions for use and all applicable federal, state, and local laws and regulations. Nothing on this site is professional, clinical, or regulatory advice.

10. Manufacturer warranties; our disclaimer

Products may carry warranties offered by their manufacturers, which pass through to you to the extent permitted. Except for any such manufacturer warranties and except as required by law, products and this website are provided “as is” and “as available,” and Nowak disclaims all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

11. Limitation of liability

To the fullest extent permitted by law, Nowak will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from your use of the site or products. Our total liability for any claim relating to a product or order will not exceed the amount you paid for the product or order giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Nowak and its officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the site or products or your breach of these Terms.

13. Intellectual property

The site and its content—including text, graphics, logos, and the Nowak name and brands—are owned by or licensed to Nowak and are protected by law. You may not copy, reproduce, or use our content without our written permission.

14. Acceptable use

You agree not to use the site unlawfully, to interfere with its operation or security, to scrape or harvest data without permission, or to introduce malicious code.

15. Text messaging

If you opt in to receive text messages from us, our SMS Terms also apply.

16. Changes to these Terms

We may update these Terms from time to time. Changes are effective when posted, and the “last updated” date above will reflect the revision. Your continued use of the site after changes are posted constitutes acceptance.

17. Governing law

These Terms are governed by the laws of the State of Mississippi, without regard to its conflict-of-laws rules. The exclusive venue for any dispute will be the state or federal courts located in Mississippi, and you consent to their jurisdiction, except where prohibited by law.

18. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with any policies referenced here and any written agreement between us, are the entire agreement regarding your use of the site and purchases from Nowak.
